Dow Chemical Canada has been awarded $1.06 billion dollars in damages against Nova Chemicals Corporation, following a dispute over the ethylene plant at Joffre.

The production facility in Joffree, known as E-3, is at the centre of the dispute, where Dow Canada alleged breach of contract against Nova, claiming they took part of the ethylene and other products which belonged to Dow, and failed to run the facility at full production.

Justice Barbara Romaine of Alberta Court of Queen’s Bench ruled in favour of Dow and against Nova’s counterclaim.

The plant began operation in 2000 as a joint venture between the two companies, with Nova running the facility.

Representatives from the Nova plant at Joffre were not immediately available for comment.
